What type of information we have

We currently collect and process the following information:

  • Your name, address, date of birth, contact phone number
  • Your medication, your GP
  • For diabetics only: Your medical condition and the way you manage this condition*
  • For the flu scheme only: Which demographic applies to you with regard to age and/or medical condition*
  • For the Medicines Compliance Scheme: Details of any additional assistance provided to help you manage your medication*

How do we get the information and why we have it

The information we process is provided to us directly by you or your representative for one of the following reasons:

  • To dispense your prescriptions
  • To send you messages to keep you updated regarding your prescription
  • To provide you with the appropriate States of Jersey Services eg provision of diabetic supplies, flu vaccination, additional assistance so you can manage your medication more effectively. We will take you through specific consent form for each of these services.

 

We may also receive information from the following sources in the following scenarios:

  • The Jersey General Hospital when your medication is changed during admission to hospital or attendance at an out-patient clinic
  • Your nominated care agency, as they are appointed or clarifying your requirements with regard to your medication
  • Your GP when the prescription supplied requires further detail to ensure safe and accurate dispensing

 

Under the data Protection (Jersey) Law 2018, the lawful basis we rely on for processing this information are:

  • We have a legal obligation – refers specifically to prescriptions for controlled drug medication, Misuse of Drugs (Jersey) Law 1978

 

We may share this information with: 

States Of Jersey Customer and Local Services Department, in order to gain payment for the services provided.

 

The Jersey General Hospital to facilitate preparation of admission records and safe discharge processes.

 

Your Care Provider to facilitate appropriate medicines management in your home.

 

The Chief Pharmacist to comply with legal requirements concerning prescriptions for controlled drugs.

 

Other pharmacies in Jersey. This only refers to the records relating to the Diabetic Supply Scheme.

 

How we store your information

Your information is securely stored:

  • Digital records of your dispensed prescriptions are retained in the Pro-Script Patient Medication Record System. These records are retained for a period as determined by our insurers.
  • Jersey Health Insurance prescriptions are retained in the dispensary until the month end when they securely transported to the Customer and Local Services Department who arrange for the pricing of the prescriptions so the pharmacy might be paid. These prescriptions are retained by CLS for 3 Years before being destroyed.
  • Prescriptions for certain categories of controlled drugs are recorded in Controlled Drug Registered which are retained for a period of 5 years in accordance with Jersey Law.
  • Private prescriptions are retained in the pharmacy for a period of 2 years in accordance with Jersey Law.
  • For States of Jersey Services as previously detailed, your data is recorded and stored on PharmOutcomes, a system maintained by States of Jersey CLS Department. The data is retained for 10 years

 

Your data protection rights 

Under data protection law, you have rights including: 

  • Your right of access – You have the right to ask us for copies of your personal information. 
  • Your right to rectification – You have the right to ask us to rectify information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete. 
  • Your right to erasure – You have the right to ask us to erase your personal information in certain circumstances. 
  • Your right to restriction of processing – You have the right to ask us to restrict the processing of your information in certain circumstances. 
  • Your right to object to processing – You have the right to object to the processing of your personal data in certain circumstances. 
  • Your right to data portability – You have the right to ask that we transfer the information you gave us to another organisation, or to you, in certain circumstances. 

 

You are not required to pay any charge for exercising your rights. 

 

If you make a request, we have four weeks to respond to you.
